2. What personal data do we process?

Which data we process depends on how you use our website and services.

We may process, among other things, the following data:

  • name;

  • delivery and billing address;

  • email address;

  • phone number;

  • order and purchase information;

  • payment and transaction details;

  • return and refund details;

  • information provided to us when you contact us;

  • data provided when leaving a review;

  • IP address;

  • browser and device data;

  • information about the use of our website;

  • cookie data and similar online identifiers;

  • data necessary for fraud prevention, security, and the prevention of misuse.

When you provide us with an image, photo, or design for a custom product, we also process these files as necessary to fulfill your request or order.

We ask that you do not provide us with sensitive personal data unless it is necessary.


3. Why do we use your personal data?

We only process personal data when there is a valid reason to do so.

Processing orders

When you place an order, we use your data to:

  • handle the payment;

  • produce and ship your order;

  • send order confirmations and shipping information;

  • process returns and refunds;

  • contact you when necessary for your order.

The legal basis for this is, in most cases, the performance of the agreement we enter into with you.

Customer service

When you contact us with a question, complaint, or request, we process the information necessary to assist you.

We do this because it may be necessary for the performance of our agreement or because we have a legitimate interest in providing good customer service.

Administration and legal obligations

4. Shopify

Our webshop is hosted and technically powered by Shopify.

When you visit our website or place an order, Shopify may process personal data necessary to provide the webshop and related services. This may include, for example, contact information, order details, device and browser information, IP addresses, and information about your interaction with our webshop.

For many of these processes, Shopify acts as a processor on behalf of WallArtistic. For certain Shopify services, Shopify may also be a controller responsible for how personal data is processed.

Depending on the features enabled in our Shopify store, Shopify may also use data for additional services, such as security, analytics, personalization, and service improvements.

Where consent is required for such features, they will only be used in accordance with the consent choices you make on our website.

5. Payments

For processing payments, we use payment providers and financial institutions.

Depending on the payment method you choose, your payment may be processed via, for example, Shopify Payments, Mollie, or an underlying bank or payment service provider.

For this purpose, data such as your name, payment details, order amount, transaction data, IP address, and other information necessary for payment and fraud prevention may be processed.

Payment service providers may act as independent controllers for certain processing activities. They process personal data in accordance with their own privacy policies and legal obligations.

In principle, WallArtistic does not receive your full payment card details. We mainly receive the information necessary to determine whether a payment has been successful and to administratively process your order.

6. Email and communication

For our business email traffic, we may use Google Workspace, including Gmail.

When you send us an email, personal data may be processed through Google's systems.

Google processes such data in accordance with the agreements applicable to Google Workspace and the relevant privacy and data protection regulations.

We only use the content of your correspondence for the purposes for which it is necessary, such as customer service, processing an order, or handling a complaint.


7. Shipping and delivery

To deliver your order, we share the necessary personal data with carriers and logistics partners.

For this, we may use, among others:

Depending on your order or delivery destination, we may also use another carrier.

We only share data that is necessary for delivery, such as:

  • name;

  • delivery address;

  • email address;

  • phone number, if necessary for delivery;

  • shipping and order information.

Carriers may be independently responsible for certain data processing activities to comply with their own legal and operational obligations.


8. Production and fulfillment partners

For certain products, we may collaborate with external production or fulfillment partners.

When an external partner is involved in producing or shipping your order directly, we share only the personal data necessary for that purpose.

This may include, for example, your name, delivery address, and information about the product ordered.

This data is shared exclusively when necessary to fulfill your order.


9. Reviews

We may invite customers to leave a review regarding their order or our webshop.

For this, we may use WebwinkelKeur or another review service.

To send a review invitation, we may share, for example, your:

  • name;

  • email address;

  • order number;

  • and information about your order

with the review service.

When you post a review yourself, the data you enter is processed in accordance with the terms and privacy policy of the relevant review service.

A review may be displayed publicly, in whole or in part.


10. Administration and accounting

We process order and billing data for our financial administration.

For this, we may use administrative software, accounting service providers, and other parties necessary for our business administration.

These parties only receive data that is necessary for the respective service provided.

We are required by tax law to retain certain administrative data for a legal period.

Our website uses cookies and similar technologies.

13. Who do we share personal data with?

We do not sell your personal data.

We only share personal data when necessary for our services, when you have given your consent, or when we are legally obliged to do so.

This may include, for example:

  • payment providers and banks;

  • carriers;

  • production and fulfillment partners;

  • Google and other IT and communication service providers;

  • review services;

  • administration and accounting software;

  • professional advisors, to the extent necessary;

  • government authorities when we are legally required to provide data.

When a party processes personal data on our behalf, we make agreements regarding the processing and security of this data where necessary.


14. Transfer outside the European Economic Area

Some of our service providers operate internationally. Consequently, personal data may in certain cases be processed outside the Netherlands or outside the European Economic Area.

When personal data is transferred to a country for which no adequacy decision from the European Commission applies, we or our service providers ensure that a valid transfer mechanism is used.

This may include, for example, standard contractual clauses approved by the European Commission or another legally permitted protection mechanism.


15. How long do we retain personal data?

We do not retain personal data longer than is necessary for the purpose for which it was collected, unless we are legally required to retain data for longer.

We apply the following principles, among others:

Order, invoice, and administrative data
We generally retain data that is part of our fiscal records for at least 7 years, insofar as the fiscal retention obligation requires this.

Customer service and correspondence
We retain correspondence for as long as necessary to handle a question, complaint, or dispute, and for no longer than is reasonably necessary thereafter.

Customer accounts
We retain data that is part of a customer account for as long as the account is in use or as long as it is necessary for the related services and legal obligations.

Marketing data
We retain data for email marketing until you unsubscribe or until the data is no longer necessary for the marketing purpose in question.

Cookie and analytics data
The retention period varies by cookie and service. Current retention periods are made available where applicable via our cookie settings or cookie banner.

When data is no longer necessary, we delete or anonymize it, unless a legal obligation or legitimate interest requires that we retain it for longer.


16. Security

We take appropriate technical and organizational measures to protect personal data against loss, misuse, unauthorized access, unwanted disclosure, and unauthorized modification.

Among other things, we use secure connections and security measures from the platforms and service providers we work with.

No method of storage or transmission over the internet can guarantee complete security. Therefore, we continue to assess and improve our security measures where necessary.


17. Automated decision-making and fraud prevention

Our webshop, Shopify, and payment providers may use automated systems to detect potential fraud, abuse, or security risks.

In principle, WallArtistic does not make decisions that have significant legal consequences for you based solely on fully automated decision-making, unless this is legally permitted and the associated rights are guaranteed.

Payment providers and other service providers may use their own automated fraud prevention systems. You can find more information about this in their own privacy statements.


18. Your privacy rights

Under the GDPR, you have various rights regarding your personal data.

Depending on the situation, you can ask us to:

  • provide access to your personal data;

  • correct incorrect personal data;

  • delete your personal data;

  • restrict the processing of your personal data;

  • object to certain processing;

  • transfer your personal data;

  • withdraw consent you previously gave.

Withdrawing consent does not affect the lawfulness of processing that took place before you withdrew your consent.

Not every right applies in every situation. For example, we cannot delete certain personal data when we are legally required to retain it.

To process an order, we need certain personal data, such as your name, delivery address, contact details, and information necessary to process the payment.

If you do not provide this necessary data, we may not be able to fulfill the order.

Other data is provided voluntarily, unless otherwise indicated.

We may adjust this privacy policy when our services, systems used, or laws and regulations change.

On this page, you will always find the most recent version and the date on which the policy was last updated.
